Damage Waiver and Security Deposit Terms

In short: instead of paying a refundable security deposit, you can pay a small non-refundable Damage Waiver fee before check-in. If accidental damage occurs in the apartment during your stay, we will not charge you for it, up to the cover limit for your unit type. The Waiver does not cover access cards and keys, smoking, parties, unregistered guests, pets or deliberate damage; these are charged separately at the rates below, and you remain responsible for them and for any amount above the cover limit. You always keep the option of paying the refundable deposit instead.

1. About these terms

1.1

These terms apply to every stay in a unit operated by First Class, whatever platform the booking was made on, and form part of your rental agreement with us. They are presented in the pre-arrival portal and must be accepted before check-in details are released.

1.2

The Damage Waiver is a contractual waiver by First Class of its right to claim certain amounts from you. It is not an insurance policy and no insurer is involved. See clause 12.

1.3

The person who made the booking accepts these terms on behalf of every occupant and is jointly and severally responsible with them for all amounts due under these terms.

2. Definitions

“Unit” means the accommodation booked, including its furniture, furnishings, fixtures, appliances, linens and other contents provided by us.

“Stay” means the period from check-in to check-out under one booking.

“Accidental Damage” means sudden and unintended physical damage to the Unit or its contents caused during the Stay by you or a registered guest, including accidental staining or breakage. Whether damage qualifies as Accidental Damage is determined by First Class, acting reasonably.

“Waiver” means the Damage Waiver described in clause 4. “Fee” means the Waiver fee in the Schedule.

“Deposit” means the refundable security deposit in the Schedule.

“Schedule” means the table in clause 5.

3. Your choice before check-in

3.1

Before check-in, every booking must complete our secure pre-arrival registration, which includes guest identification required by Dubai regulations and one of the following: payment of the Waiver Fee, or payment of the Deposit.

3.2

Check-in details and building access are released only once registration is complete. If registration is not completed, we may refuse check-in until it is, and any resulting cancellation or no-show is treated under the cancellation policy of your booking.

3.3

Where your booking platform provides its own damage-protection or resolution process, we may rely on it instead of, or alongside, these terms.

4. The Damage Waiver

4.1

If you pay the Fee, First Class waives its right to charge you for Accidental Damage discovered during or after your Stay, up to the cover limit in the Schedule for your unit type, per Stay in aggregate.

4.2

The Fee is payable once per Stay per Unit, is stated in AED, and is non-refundable from the moment of check-in. If the booking is cancelled before check-in, the Fee is refunded in full.

4.3

The Waiver applies to the person who made the booking and to registered guests within the permitted occupancy of the Unit.

4.4

Amounts above the cover limit, and everything listed in clause 7, remain your responsibility and are payable in accordance with clause 10.

Amounts are stated in AED and include VAT where applicable.

6. What the Waiver covers

Accidental Damage to furniture, furnishings, fixtures, doors, walls, floors and appliances inside the Unit.

Accidental breakage of crockery, glassware, kitchenware and decorative items provided by us.

Accidental staining of, or damage to, linens, towels, mattresses, curtains, sofas and carpets, including specialist cleaning where required.

Accidental damage caused by children within the registered occupancy.

7. What the Waiver does not cover

The following are excluded and are payable in accordance with clause 10:

Loss of, or damage to, building access cards, keys, key fobs and parking remotes: the building’s prevailing replacement cost as charged by the building or community management, typically AED 300 to 1,000, plus an administration charge of AED 100 per item.

Smoking or vaping of any kind inside the Unit, including shisha: odour treatment and deep-cleaning charge of AED 1,500.

Parties, events or gatherings, and occupancy above the registered number of guests: charge of AED 1,500, plus the cost of any resulting damage, which is not covered by the Waiver.

Pets brought without our written approval: deep-cleaning charge of AED 750, plus any resulting damage.

Intentional, reckless or malicious damage, and damage arising from unlawful activity or from breach of the house rules.

Theft or unexplained removal of items from the Unit.

Damage to common areas, the building, community or owners-association property, other units, or third-party property, including any fines or charges imposed on First Class or the unit owner as a result of your conduct.

Your own belongings and vehicles.

Amounts above the cover limit in the Schedule.

Normal wear and tear is not Accidental Damage and is not charged to guests.

8. Your obligations

8.1

The Waiver applies only if the Stay complies with the house rules, including the no-smoking, no-party and registered-occupancy rules, and only if the registration information provided is accurate. Damage arising from a breach is excluded under clause 7, and First Class may treat the Waiver as void for damage connected to a breach or to false registration information.

8.2

You must report any damage to us without delay and no later than check-out. Concealment of damage voids the Waiver for that damage.

8.3

You must return all access cards, keys and remotes at check-out as instructed, and allow First Class to inspect and document the Unit.

9. The Security Deposit option

9.1

If you choose the Deposit instead of the Waiver, the amount in the Schedule is collected through our secure payment provider before check-in.

9.2

The Deposit is refunded within 14 days of check-out, or such longer period as First Class reasonably requires to assess the Unit, less any amounts due under these terms as determined by First Class.

9.3

If amounts due exceed the Deposit, the balance remains payable by you in accordance with clause 10.

10. Charges and payment

10.1

Amounts payable for excluded items, for amounts above the cover limit, and for stays where no Waiver was taken are determined by First Class by reference to the Schedule, the charges of the building or community management, supplier and procurement costs, and the cost of repair or replacement carried out by First Class, including labour at First Class’s standard rates.

10.2

First Class will notify you of the amount due, and it is payable immediately on notification.

10.3

You irrevocably authorise First Class to collect any amount due under these terms by deducting it from any Deposit held and by charging the payment card provided during booking or pre-arrival registration. First Class may also pursue any amount through the damage-resolution process of the platform you booked on, and where a replacement access card or key is required during your Stay, First Class may make its issuance conditional on prior payment of the replacement charge.

10.4

Amounts due and unpaid may be referred to a collection agency or pursued through legal proceedings, and you are responsible for the reasonable costs of recovery.

11. Payment, currency and taxes

11.1

All amounts are stated in AED, include VAT where applicable, and are collected by our PCI-compliant payment provider using secure authentication.

12. This is not insurance

12.1

The Waiver is a contractual arrangement between you and First Class under which we agree not to pursue certain amounts from you. It is not an insurance contract, we are not an insurer, and no insurance intermediation takes place. It creates no rights for any third party.

13. General

13.1

These terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and the Dubai courts have exclusive jurisdiction.

13.2

First Class is a holiday-home operator licensed by the Dubai Department of Economy and Tourism.

13.3

If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms for future bookings; the version accepted in your pre-arrival portal applies to your Stay.

2. Booking Terms

Properties listed on this site may be reserved either directly through the website or via third-party platforms. The booking process will vary depending on the platform used.

  • Minimum Age: Guests must be at least 21 years old to book.

  • Identification: Valid government-issued identification may be required before or at check-in.

  • Payments: A deposit or full payment is typically required at the time of booking. Specific payment terms will be outlined prior to confirmation.

  • House Rules: Acceptance of the property’s house rules is required. These may include policies on noise, guest limits, check-in/out times, and use of amenities.

Failure to comply with booking terms may result in cancellation without refund.


3. Cancellations & Refunds

The cancellation and refund policy will be clearly stated during the booking process. Typical policies include:

  • Full Refund: For cancellations made more than 30 days before arrival.

  • Partial Refund: For cancellations made 14–30 days before arrival.

  • No Refund: For cancellations made within 14 days of arrival.

If the booking is made through a third-party platform (such as Airbnb, Vrbo, etc.), their respective cancellation and refund policies apply and may differ from those listed above.


4. Guest Responsibilities

Guests agree to treat the property and surrounding area with care and respect throughout their stay.

  • Adherence to House Rules: Guests must comply with all posted or communicated rules.

  • Occupancy Limits: Only the number of guests specified in the reservation may stay overnight.

  • Parties & Events: Unauthorized gatherings, parties, or events are strictly prohibited.

  • Damages: Guests are financially responsible for any damages, excessive cleaning, or lost items caused during their stay.

  • Pets & Smoking: Unless explicitly allowed, pets and smoking are not permitted on the premises.

Violation of guest responsibilities may result in eviction and/or charges for damage or extra cleaning.


5. Use of Website

Users agree not to engage in any unauthorized or unlawful activity when using this website.

Prohibited behaviors include but are not limited to:

  • Attempting to breach or compromise site security

  • Transmitting spam or unsolicited messages

  • Scraping, duplicating, or misusing content or data from the site

All content on this website is the intellectual property of the site owner unless otherwise stated. Reproduction or redistribution without permission is prohibited.


6. Liability Disclaimer

The operator of this site and its partners are not responsible for:

  • Website Issues: Temporary unavailability, inaccuracies, or technical errors

  • Guest Incidents: Injuries, accidents, losses, or thefts occurring during a stay

  • Force Majeure: Delays or cancellations due to natural disasters, weather, strikes, government actions, or other uncontrollable events

Guests are advised to obtain appropriate travel and medical insurance prior to their stay.
